Contest Privacy Policy

This privacy policy is applicable to the Extreme Home Accessibility Home Renovation Contest (the “Contest”) and the contest online portal located at www.durhamhomerenocontest.ca (the “Contest Portal”). The Contest is sponsored by Durham Medical 1983 Ltd. (“Durham Medical”) and John McLellan Contracting Inc. (“JMC”; Durham Medical and JMC are collectively referred to as the “Sponsors”). The Contest Portal is operated by or for Durham Medical. Capitalized terms that are not defined in this privacy policy will have the meaning ascribed to them in the official contest rules for the Contest which are available at www.durhamhomerenocontest.ca/index.php/terms-and-conditions

If you are less than the age of majority in the province or territory in which you reside, you must first obtain the permission from your parents or legal guardians before you register to receive such information or otherwise provide the Sponsors with any of your personal information. To enter the Contest, you must be at least 19 years of age at the time of entry.

Communication of information using the Internet or e-mail is not a secure medium and you understand that such communications may be intercepted, altered, distorted, delayed or blocked. You understand that such communications may not be appropriate with respect to personal information. You assume any and all risks with respect to any such communication.

Any personal information (information that identifies an individual) collected by the Sponsors in conjunction with the Contest, via the Contest Portal or otherwise, is collected for the purpose of administering the Contest. Personal Information collected via the Contest Portal is required for the purposes of communication, Contest eligibility verification, selection of finalists and grand prize winner, fulfillment, realization and delivery of the Contest prize, and other matters relating to the administration of the Contest. The Sponsors do not and will not rent, sell or trade any personal information obtained in conjunction with the Contest or through access and use of the Contest Portal to outside individuals or organizations.

When you submit your Online Application (and associated Personal Story) and when you submit writings on a particular topic, we learn your name, address, telephone number, e-mail address, confirmation that you are at least 19 years of age, information about your personal situation and daily challenges that you face, or any facts, opinions or other information that you volunteer. Where such response or writings are submitted in conjunction with the Contest, we may use these for the purposes of administering the Contest. You are NOT required to provide any personal health information with respect to your Online Application and associated Personal Story but if you do, you consent to use of the foregoing with respect to the Administration of the Contest and certain marketing purposes, as expressly detailed below.

We may aggregate and consolidate personal information about all Contest participants or visitors of the Contest Portal for research, marketing, administrative and operational purposes. Such aggregated information will be made anonymous and will therefore no longer be personally identifiable or constitute personal information.

Access to personal information is restricted to authorized Sponsor personnel, and agents acting on their behalf (including, in the case of Finalists, an occupational therapist), who require personal information to administer the Contest. All Sponsor personnel and authorized agents handling this information have been briefed on our privacy policy and procedures. The Sponsors are committed to maintaining the confidentiality and security of the personal information they collects and the privacy of the individuals who share their personal information. Your information is kept secure via a secure database with restricted access.

Emails submitted to Durham Medical become the exclusive property of Durham Medical, subject to applicable laws relating to privacy and data protection as same may apply to any personal information contained in such e-mail.

The Contest Portal uses cookies to enhance visitors’ browsing experience. While these cookies may store information, such as browser type and IP Address, they are in no way attached to other personal information such as a visitor’s name, email address or phone number. Disabling cookies on your web browser will prevent collection of such information but may affect proper or efficient use of the Contest Portal.

Each Finalist will be required to provide access to the Sponsors and their agents, to his or her personal residence in conjunction with the Site Visit. The Sponsors and their agents may collect additional personal information in conjunction with the assessment of the Finalist’s needs and the available Accessibility Renovations (and suitability of the foregoing for the Finalist), as well as the assessment of the principal residence and the possibility of undertaking the Accessibility Renovations safely, in a timely manner and within the monetary limits set forth in the Contest Rules. This may include an assessment of the state of repair of the personal residence and information about the other occupants of the personal residence. Your participation in the Contest is conditional upon such other occupants providing their consent with respect to such collection and use of their personal information.

The Winner agrees that his name and Personal Story (or a summary or extracts thereof) may be reproduced, published, broadcasted, or distributed to the public and used by the Sponsors for promotional purposes. Where the Personal Story contains personal information (including, personal health information), the Winner consents to disclosure and other use of such personal information (including, personal health information) as described above. If you do not wish any such personal information (or personal health information) disclosed or used in this manner, do not include such information in your Personal Story. Likewise, the Winner agrees to have his or her picture taken and to have pictures of his or her personal residence (interior and exterior) taken, on one or more occasions by or for Sponsor for promotional purposes, including, without limitation, an announcement by the Sponsor of the Contest Winner via a live award presentation, newsletters, e-mail blasts, promotional webpages on the Contest Portal and the Sponsors’ respective websites and in any other publication, regardless of form, format and medium. The Winner further agrees to use of his or her voice, image, pictures, and/or likeness in association with Sponsor promotional activities relating to the Contest.
